The court found that although the previous suits between the parties involved the same subject matter and parties, they were dismissed for want of attendance and not heard and determined on merits. Therefore, the doctrine of res judicata under Section 7 of the Civil Procedure Act did not apply. However, the court held that under Order 12 Rule 6(2) of the Civil Procedure Rules, once a suit has been dismissed for non-attendance, no fresh suit may be brought in respect of the same cause of action.
