Procedural Posture

Miscellaneous Application / Ruling on Preliminary Objection

  1. 1 Does the Employment and Labour Relations Court have jurisdiction to adopt and enforce awards made by the Director of Occupational Safety and Health Services (DOSH)?
  2. 2 Is the applicant's claim time-barred under the relevant statutory limitation period?
  3. 3 Are illegible documents sufficient to support an application for enforcement of a DOSH award?

Ratio Decidendi

The court held that it lacks jurisdiction to adopt and enforce awards made by the Director of Occupational Safety and Health Services as judgments of the court, as neither the Work Injury Benefits Act nor the Employment and Labour Relations Court Act expressly confers such power. The only jurisdiction conferred by WIBA is appellate, not enforcement. The court further found that the applicant's supporting documents, specifically the DOSH forms, were illegible and therefore insufficient to support the application. Consequently, the preliminary objection was upheld and the application was struck out.

Court Disposition

Application struck out for want of jurisdiction and insufficiency of supporting documents.
