Miscellaneous Application / Ruling on Application for Leave to File Suit Out of Time

  1. 1 Whether the court has jurisdiction to extend time for filing an employment claim beyond the statutory limitation period.
  2. 2 Whether the applicant has provided sufficient grounds for extension of time to file the suit out of time.

Ratio Decidendi

The court held that, notwithstanding the applicant's reasons for delay and the arguments based on the court's inherent powers and the need for substantive justice, Section 90 of the Employment Act expressly limits the period within which employment-related claims may be brought to three years. The statute does not grant the court discretion to extend this period, and therefore, the court lacks jurisdiction to allow the filing of a claim out of time. The application for extension of time was thus dismissed for want of merit.
