Procedural Posture

Criminal Petition / Sentence Review Ruling

  1. 1 Whether the High Court has jurisdiction to review and substitute a custodial sentence with probation where the Executive has not made such a request.
  2. 2 Whether the period spent in remand custody should be deducted from the custodial sentence under section 333(2) of the Criminal Procedure Code.
  3. 3 Whether the petitioner has demonstrated sufficient reformation to warrant non-custodial measures.

Ratio Decidendi

The court held that it lacks jurisdiction to substitute a custodial sentence with probation unless invited by the Executive or where issues of legality or rights violations arise. The petitioner had not demonstrated any such grounds, and there was no report from the Kenya Prison Service to support his claim of reformation. However, the court found that the period spent in remand custody must be deducted from the sentence pursuant to section 333(2) of the Criminal Procedure Code. The court therefore ordered that the period of one year and fifteen days spent in remand custody be deducted from the ten-year sentence imposed on the petitioner.

Court Disposition

Petition for sentence review to probation dismissed; order for deduction of remand period granted.

Orders

  • The period of one year and fifteen days spent in remand custody shall be deducted from the ten-year custodial sentence.
  • A certified copy of the ruling shall be served on the Kenya Prisons Service, the applicant, and the Director of Public Prosecutions.
