Ratio Decidendi

The High Court lacks jurisdiction to entertain an application for leave to appeal out of time in a matter whose subject is title to land. The Constitution and the Environment and Land Court Act vest exclusive jurisdiction over such disputes, including appeals, in the Environment and Land Court. Since the lower court's decision concerned the transfer of land title, any appeal must be directed to the ELC, not the High Court. The application is therefore fundamentally misconceived and must be dismissed for want of jurisdiction, regardless of its merits.
