The court found that the firm of Marende Necheza & Company Advocates filed the consent order on 2nd November 2021 after they had been removed from the record and replaced by J J Chesaro & Company Advocates, who had duly filed and served a notice of change of advocate. The consent was entered without the defendant's knowledge or instructions, amounting to misrepresentation and fraud. The court held that the requirements of Order 9 Rule 9 of the Civil Procedure Rules had been satisfied by the new advocates, and the consent was therefore entered fraudulently by the previous advocates. As such, the consent order was set aside and the case was reopened for hearing on its merits.
