The applicant's claim that the trial court ignored his review application was not supported by the record, which showed that the review application stalled due to the applicant's non-compliance with court directions, including failure to pay costs and attend court. The court held that the applicant could not pursue both review and appeal against the same order, as section 80 of the Civil Procedure Act requires a party to elect between the two remedies.
