The court held that the appeal and the miscellaneous cause were never consolidated, and therefore, the pending application in the miscellaneous cause could not be determined together with the appeal. The only application in the appeal, for stay of execution, had already been dismissed and could not be revisited. The court directed that the appellant should proceed to file his appeal at the Court of Appeal if aggrieved by the judgment, and that the Deputy Registrar should facilitate the preparation of proceedings and judgment for that purpose.
