Since the defendant resides in Siaya County and the land in question is also located there, the proper court with geographical jurisdiction is the Siaya Chief Magistrate’s Court. The court further held that leave to appeal was necessary for this type of appeal but was not obtained. As there was no objection to the transfer and no prejudice to the plaintiff, the court ordered the transfer of the suit from Maseno Law Courts to Siaya Law Courts.
