Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant's employment was procedurally fair under the Employment Act, 2007.
  2. 2 Whether the Respondent had valid and fair reasons for terminating the Claimant's employment on grounds of poor performance.
  3. 3 Whether the Claimant is entitled to compensation and other remedies for unfair termination.

Ratio Decidendi

The court found that while the Respondent had valid and fair reasons to terminate the Claimant's employment due to poor performance, the process followed was procedurally unfair. The Respondent failed to provide clear notice of contemplated termination and did not afford the Claimant an opportunity to make representations as required by law. The performance review meetings did not substitute for the statutory hearing under section 41 of the Employment Act. Consequently, the termination was declared procedurally unfair, and the Claimant was awarded compensation equivalent to five months' gross wages, with interest and costs, and was entitled to a certificate of service.

Court Disposition

Claim partly allowed; termination declared procedurally unfair; compensation awarded.

Orders

  • The termination of the Claimant's employment is declared procedurally unfair.
