Section 90 of the Employment Act provides a strict three-year limitation period from the date of termination. The claimant was terminated on 2nd March, 2021, and therefore ought to have filed the claim by 2nd March, 2024. The claim, filed on 8th April, 2024, was thus statute barred. The preliminary objection raised a pure point of law suitable for summary determination and was upheld. Consequently, the claim was struck out with costs to the respondent.
