Ratio Decidendi

The court held that the applicants, having filed a Notice of Appeal against the judgment, are precluded from seeking review of the same judgment. The remedies of appeal and review are mutually exclusive and cannot be pursued concurrently. The filing of a Notice of Appeal is deemed as instituting an appeal, thereby ousting the jurisdiction of the High Court to entertain an application for review. The application for review was therefore incompetent and amounted to an abuse of the court process. Consequently, the prayers for review and stay of execution were declined and the application was dismissed. Each party was ordered to bear its own costs.
