The High Court found that the offences of rape and grievous harm arose from the same transaction, as the assault was immediately followed by the act of rape. Applying established legal principles and precedents, the court held that, in such circumstances, sentences should run concurrently unless there are exceptional reasons to do otherwise. The trial court's order for consecutive sentences was therefore set aside and replaced with an order for concurrent sentences. On the issue of remand custody, the High Court determined that the trial magistrate had expressly considered the period spent in custody when passing sentence, as reflected in the sentencing remarks.
