Procedural Posture

Civil Case / Ruling on Contempt Application

  1. 1 Whether the respondents were served with the court order of injunction issued on 17th April 2018.
  2. 2 Whether the respondents disobeyed the court order by entering and cultivating the suit land.
  3. 3 Whether the applicants proved contempt of court to the required standard.

Ratio Decidendi

The court found that while service of the injunction order on the respondents was sufficiently proved, the applicants failed to particularise the acts of contempt and to specify which respondent committed which act on which parcel of land. The evidence presented, including letters from the applicants' advocate and the area chief, was too general and did not meet the higher standard of proof required in contempt proceedings. The applicants did not discharge their burden to prove disobedience of the court order to the requisite standard. Consequently, the application for committal of the respondents to civil jail for contempt was dismissed.
