Under Section 7 of the Limitation of Actions Act, the plaintiff had twelve years from accrual to file suit, expiring on 12th March 2011. The suit, filed in March 2023, was therefore filed twelve years out of time. The court held that limitation statutes bar the remedy sought and, where the bar is apparent from the plaint and no exemption is pleaded, the plaint must be rejected.
