Miscellaneous Criminal Application / Sentence Review Application; Ruling on Application for Sentence Revision

  1. 1 Whether the High Court has jurisdiction to review or revise a sentence imposed by a court of concurrent jurisdiction.
  2. 2 Whether the applicant's mitigation and circumstances warrant a reduction of sentence.

Ratio Decidendi

The High Court held that it does not have jurisdiction to review or revise a sentence imposed by a court of concurrent jurisdiction. The applicant's mitigation factors had already been considered by the trial court at the time of sentencing. There is no constitutional or statutory provision empowering the High Court to sit on appeal or revision of its own judgment or that of another court of the same level. Entertaining such an application would be unconstitutional and illegal. Consequently, the application for sentence review lacked merit and was dismissed in its entirety.

Court Disposition

Application dismissed.

Orders
