The court found that while the appellants complied with the procedural requirements for instituting a representative suit and the causes of action were similar, the trial court correctly determined that it lacked pecuniary jurisdiction to hear the matter. The claims by each claimant exceeded the KSh. 80,000 threshold set by Gazette Notice No. 6024 of 10th June, 2018, which delegates jurisdiction to Magistrates Courts in employment matters. As jurisdiction is fundamental, the trial court was right to dismiss the suit for want of jurisdiction, regardless of compliance with representative suit procedures. The appeal was therefore dismissed and the trial court's decision upheld.
