The Court found that the National Quality Control Laboratory, established as a juristic person under the Pharmacy and Poisons Act, is the legal employer of the 4th and 5th respondents and has direct disciplinary control over them. Given the allegations in the petition concern the conduct of these employees in their official capacities, the Laboratory is a necessary party for the just and expeditious determination of the dispute. The Board of Management, as the organ with disciplinary mandate, must formally resolve to participate in the proceedings.
