Procedural Posture

Miscellaneous Application / Ruling on Application for Removal of Legal Guardians/managers

  1. 1 Whether the respondents, as appointed guardians, misappropriated estate funds for personal benefit.
  2. 2 Whether sufficient cause exists for the removal of the respondents as legal guardians/managers of the subject's estate.
  3. 3 Whether the respondents breached their fiduciary duties to the subject.

Ratio Decidendi

The court found that the respondents, as guardians, paid themselves from the estate of the subject and used estate funds to settle a personal loan, actions which were not denied by the respondents. These acts constituted a breach of the fiduciary relationship imposed by the court and were not in the best interest of the subject. The court determined that sufficient cause existed for the removal of the respondents as guardians and managers of the estate. The court further directed that all monies paid to the respondents from the estate be repaid and that a full account of all estate transactions be delivered to the new guardians.
