Procedural Posture

Originating Summons / Judgment

  1. 1 Whether the plaintiff has proved a claim of adverse possession over a portion of L.R. No. North Sakwa/Kadera Lwala/61 measuring approximately 1.2Ha (3 Acres).
  2. 2 Whether the plaintiff is entitled to the reliefs sought, including transfer and registration of the suit property.

Ratio Decidendi

The court found that the plaintiff and his family have been in open, continuous, and uninterrupted possession and use of the disputed 3 Acres of land since 1978, a period exceeding the statutory 12 years required for adverse possession. The defendant did not dispute the plaintiff's occupation nor did he take any steps to interrupt or evict the plaintiff from the land. The court held that the plaintiff had sufficiently demonstrated acquisition of prescriptive and overriding rights over the 3 Acres by virtue of adverse possession, and was therefore entitled to the reliefs sought, including transfer and registration of the land in his name.

Court Disposition

Plaintiff's claim allowed; adverse possession established.

Orders
