Ratio Decidendi

The court found that the Applicant had provided a reasonable and satisfactory explanation for the delay in filing the application for leave to appeal, namely that he had filed another suit which was subsequently struck out, and promptly sought leave thereafter. The Respondent's claims of prejudice were unsupported by evidence, and there was no indication of abuse of process by the Applicant. Given the constitutional right to appeal and the absence of demonstrated prejudice, the court exercised its discretion to grant leave to appeal out of time, limited to 14 days from the date of the ruling. Costs were ordered to abide by the outcome of the appeal.
