The court held that it lacked jurisdiction to entertain the originating summons because a reference arising from the taxing master's decision had already been filed (Misc Application 293 of 2015) and was pending before another judge. The High Court's jurisdiction to review a taxing master's decision is only invoked upon a properly filed reference under paragraph 11 of the Advocates (Remuneration) Order. Since no such reference was before the court in this matter, and the issue of accounts could not be conclusively determined without the full proceedings and submissions before the taxing master, the application was premature.
