Ratio Decidendi

The court found that the claimant was serving under a probationary period at the time of termination, as the second contract was distinct and commenced a new employment relationship. Although section 42(1) of the Employment Act exempted the respondent from procedural fairness under section 41, the respondent was still required to provide substantive reasons for termination under sections 43 and 45. The respondent failed to provide any reason for the claimant’s termination, rendering the dismissal unfair. The court also noted that the claimant was entitled to challenge the termination despite serving less than thirteen months, as section 45(3) had been declared unconstitutional....

Court Disposition

Judgment for the claimant; partial award granted.

Orders

  • The respondent shall pay the claimant Kshs 65,000.00 as compensation for unfair termination.
  • The respondent shall pay the claimant Kshs 4,333.33 as prorated leave pay.
