Procedural Posture

Miscellaneous Application / Ruling on Application to Set Aside Dismissal and Reinstate Suit

  1. 1 Whether the order dismissing the suit should be set aside and the suit reinstated.
  2. 2 Whether the claimant was properly notified of the notice to show cause hearing.
  3. 3 Whether there was abuse of court process in seeking reinstatement.

Ratio Decidendi

The court found that the claimant, through his advocate, was at all material times aware of the court's directions, including the requirement to take a hearing date or attend court to show cause why the suit should not be dismissed. Both parties were present when these directions were issued. The claimant failed to demonstrate good cause for reinstatement, as there was no evidence of interest from the claimant himself and repeated adjournments had occurred due to ongoing settlement negotiations. The application for reinstatement was therefore without merit and constituted an abuse of court process.
