The court found that although the applicant failed to comply with the orders of 21st February 2023 due to lack of awareness and counsel's omission, the interests of substantive justice required that the applicant be allowed to prosecute the intended appeal. The court held that any prejudice to the respondent could be compensated by an award of throw away costs. The court further determined that the conditions for stay of execution previously set, including the deposit of KShs 200,000 as security, should remain in force pending the hearing and determination of the appeal.
