The title deed dated 19th May 2011, which the applicants relied on, was in their possession and knowledge at all material times, including at the time of filing the suit and throughout the litigation. The omission to present the correct title deed was due to the applicants' and their counsel's negligence, not a genuine discovery. The court held that review is not available to correct such negligence, and there was no error apparent on the face of the record.
