Procedural Posture

Criminal Revision / Ruling on Sentence Revision

  1. 1 Whether the applicant's custodial sentence for possession of cannabis sativa should be revised in light of his recidivism and the need for prison decongestion.
  2. 2 Whether community service is an appropriate alternative to continued imprisonment for the remainder of the applicant's sentence.

Ratio Decidendi

The court found that although the applicant was a recidivist, he had substantially served his custodial sentence for possession of cannabis sativa. In the interest of prison decongestion and rehabilitation, and considering the value of the drugs involved and the applicant's prior conduct, the court determined that the remainder of the sentence could be served through community service. The court thus revised the sentence, ordering the applicant's release from prison to serve the remaining three months of his sentence on community service at Bondo Police Station.

Court Disposition

Sentence revised; applicant to serve remainder of sentence on community service.

Orders

  • The applicant, Paul Baraza Oluoch, shall be released from prison to serve the remainder of his prison term of three months on Community Service at Bondo Police Station.
