Procedural Posture

Chamber Summons / Ruling on Application for Extension of Time to File Reference Against Taxation

  1. 1 Whether the court should extend time for the applicant to file a reference against the Taxing Master's decision.
  2. 2 Whether the applicant has demonstrated sufficient cause for the delay in filing the reference.
  3. 3 Whether the Taxing Master erred in awarding costs in the absence of proof of payment of agreed costs.

Ratio Decidendi

The court found that the applicant had made reasonable efforts to obtain the ruling from the Taxing Master and that the delay in filing the reference was not inordinate, given that the ruling was only received on 22nd February 2024. The court exercised its discretion under Rule 11(2) of the Advocates Remuneration Order to extend time for filing the reference, noting that the application was unopposed and that parties had been negotiating. The interests of justice required that the applicant be allowed to ventilate its case on the merits in the reference. All other prayers were struck out and each party was ordered to bear its own costs.

Court Disposition

application for extension of time granted; all other prayers struck out; parties to bear own costs
