The court found that while the Respondent complied with the statutory requirements for redundancy under section 40 of the Employment Act, it made a further contractual promise to the Claimant that termination would be effective on 30 June 2020 unless there was mutual agreement to an earlier date. No such mutual agreement was reached. By unilaterally terminating the Claimant's employment on 27 March 2020, the Respondent breached its own promise and the Claimant's legitimate expectation. The court held that the Claimant was entitled to compensation equivalent to the wages he would have earned from April to June 2020, amounting to three months' gross salary.
