Ratio Decidendi

The Environment and Land Court found that the counterclaim in CM ELC No. 204 of 2018 (Nakuru) exceeded the pecuniary jurisdiction of the Chief Magistrate's Court, necessitating transfer to the superior court. Both parties agreed on the need for transfer. However, since the present suit had already been dismissed by a prior judgment, the court was functus officio and could not consolidate the dismissed suit with the transferred matter. The court thus ordered the transfer of the subordinate court case to the Environment and Land Court for hearing and determination under a new case number, without consolidation with the dismissed suit.
