The High Court lacks appellate jurisdiction to entertain an appeal by a complainant against a decision of the Disciplinary & Ethics Committee of the Kenya Medical Practitioners & Dentists Council where no penalty has been imposed against a medical practitioner or dentist under Section 20(6) of the Medical Practitioners and Dentists Act. The statutory right of appeal under Section 20(9) is limited to a person aggrieved by a penalty imposed under Section 20(6), i.e., the practitioner found guilty, not the complainant.
