Ratio Decidendi

The defence filed by the existing defendants already represented the interests of the proposed parties, and there was no evidence that the proposed defendants wished to be enjoined or that their absence would prejudice the defence. The addition of 115 new parties would unnecessarily complicate and delay the proceedings, contrary to the overriding objective of the Civil Procedure Act. Therefore, the application for joinder and amendment of the plaint was dismissed for lack of merit.
