Miscellaneous Application / Ruling on Application for Enlargement of Time to Appeal

  1. 1 Whether the applicant has provided a satisfactory explanation for the delay in filing the appeal.
  2. 2 Whether the omission to annex a notice of appeal is fatal to the application.
  3. 3 Whether the respondent will suffer prejudice if the extension of time is granted.

Ratio Decidendi

The court found that the applicant provided a reasonable and satisfactory explanation for the delay in filing the appeal, namely, lack of awareness of the ruling's delivery due to change of advocates and late notification by the respondent. The court held that the omission to annex a notice of appeal was not fatal and could be cured under Article 159 of the Constitution. The respondent failed to demonstrate any prejudice that would result from granting the extension. Accordingly, the court exercised its discretion to enlarge the time for filing the appeal, granting the application as prayed.
