Ratio Decidendi

The High Court's jurisdiction to extend time for filing a notice of appeal is limited to situations where the notice has not yet been filed. Once a notice of appeal has been filed out of time, only the Court of Appeal has the power to extend the time for filing such notice. The filing of the notice of appeal out of time ousts the jurisdiction of the High Court, and any application for extension of time must be made to the Court of Appeal. Therefore, the application for extension of time before the High Court was incompetent and could not be granted.
