The applicant showed that substantial loss would result to the estate and heirs of the deceased defendant if execution proceeded, as they risked eviction and demolition of their residence. The court was satisfied that the application was made without unreasonable delay and that the applicant had fulfilled the conditions for grant of stay under Order 42 Rule 6 of the Civil Procedure Rules.
