Civil Case / Ruling on Preliminary Objection

  1. 1 Whether the plaintiff had locus standi to file the application dated 29.3.2005 on behalf of the estate of the deceased.
  2. 2 Whether the Power of Attorney survived the death of the donor and could confer legal capacity to the plaintiff.
  3. 3 Whether acts done prior to the issuance of letters of administration are validated by the subsequent grant.

Ratio Decidendi

The court held that the Power of Attorney under which the plaintiff purported to act was extinguished upon the death of the donor, and that the plaintiff only acquired locus standi to act on behalf of the estate upon the issuance of the grant of letters of administration on 22.9.2005. Since the application dated 29.3.2005 was filed before the grant was issued, the plaintiff lacked legal capacity to file it. The grant does not operate retrospectively to validate acts done prior to its issuance. Consequently, the application was bad in law and was dismissed for want of locus standi.
