The court found that the applicant had demonstrated the filing of a Notice of Appeal, satisfying the requirement for an appeal under Order 42 Rule 8. The applicant also showed that she would suffer substantial loss if stay was not granted, as her house could be demolished and she could be evicted. The court was satisfied that the application was made without unreasonable delay and that the applicant was willing to provide security for due performance by depositing Kshs. 200,000 in a joint interest-earning account. Accordingly, the court granted a stay of execution of the judgment pending the hearing and determination of the appeal, conditional upon the deposit of security within 45 days.
