The court held that an error in the Memorandum of Appeal regarding the decretal sum does not render the appeal or the application for stay defective, as such an error is a procedural technicality that can be amended in line with Article 159(2)(d) of the Constitution. The main issue was the nature and extent of security to be provided by the appellant. Since the appellant expressed willingness to deposit the decretal sum in a joint interest earning account, and neither party provided the impugned judgment to clarify apportionment of liability, the court found it appropriate to grant a stay of execution on condition that the entire judgment sum is deposited in a joint account in the names...
