Ratio Decidendi

The court found that the applicant was first arraigned on 15th March, 2021 and sentenced on 3rd December, 2021, amounting to 9 months in custody prior to sentencing. The trial court did not consider this period when passing sentence. Applying section 333(2) of the Criminal Procedure Code, the High Court held that the 9 months spent in custody must be deducted from the 3-year sentence. The effective sentence is therefore 2 years and 3 months, to run from 15th March, 2021.
