Ratio Decidendi

The High Court lacks jurisdiction to review or alter a sentence where the applicant has already exercised his right of appeal and the sentence has been determined by a court of concurrent jurisdiction. Section 364 of the Criminal Procedure Code expressly prohibits revisionary proceedings at the insistence of a party who could have appealed and did so. Allowing such a review would amount to the court sitting on appeal over its own decision, which is not permitted under Kenyan law. The proper forum for further challenge is the Court of Appeal, not the High Court. The application is therefore dismissed for want of jurisdiction.
