Upon review of the evidence, including the testimonies of the appellant, the investigating officer, and the 1st respondent, the court determined that both the driver of the motor vehicle (1st respondent) and the motorcycle rider (3rd respondent) contributed to the accident. The court noted that the 1st respondent failed to ensure the road was clear before turning, while the 3rd respondent overtook improperly and was unqualified.
