The court found that the applicant failed to satisfy the first requirement for the grant of stay of execution, namely, demonstrating that the intended appeal is arguable. The applicant did not point to any specific arguable ground of appeal, relying only on general assertions. Without an arguable appeal, the application for stay cannot succeed, regardless of the nugatory aspect. The court also noted that damages could reasonably compensate the respondent and that the applicant's offer to deposit the decretal sum in a joint account would cushion the respondent. However, since both requirements must be met and the applicant failed on the first, the application was dismissed.
