  1. 1 Whether the Tribunal has jurisdiction to hear and determine the complaint.
  2. 2 Whether the complainant qualified to be nominated to vie for Member of Parliament for Gem Constituency under the Communist Party of Kenya.
  3. 3 Whether the respondent was justified in refusing to submit the complainant's name to the Independent Electoral and Boundaries Commission.

Ratio Decidendi

The Tribunal found that it had jurisdiction because the complainant made honest attempts to resolve the dispute internally, but the party failed to respond. However, the complainant had, by his own written communication, withdrawn his candidature for Gem Constituency upon the party's decision to join the Kenya Kwanza Coalition. This withdrawal was clear and unambiguous, and the complainant was estopped from denying it. As such, the respondent was justified in not submitting the complainant's name to the IEBC, both due to the withdrawal and the complainant's failure to comply with party rules and code of conduct. The Tribunal found no merit in the complaint and dismissed it without orders...
