The High Court determined that it was functus officio, having already heard and decided the applicant's appeal on both conviction and sentence in Siaya HCCRA No. 55 of 2016, where the sentence was substituted from life imprisonment to 75 years. The applicant subsequently appealed to the Court of Appeal, which dismissed his appeal. The doctrine of functus officio precludes the High Court from rehearing or reviewing a matter it has already conclusively determined. As such, the court lacks jurisdiction to entertain the present application for sentence review, and the application must be dismissed for want of merit.
