There was no evidence that the land was held in customary trust for the defendants. The 1st and 2nd defendants, though sired by Ongiri Omurwa, were found under custom to be children of Nyaboke (through a woman to woman marriage), and their entitlement, if any, lay in parcel 400, not the suit land.
