Ratio Decidendi

The court found that the applicant had served the respondent with the bill of costs, and the respondent neither appeared nor challenged the taxation. The certificate of taxation issued by the taxing master was therefore final and unchallenged. Under Section 51(2) of the Advocates Act, the court is empowered to enter judgment on such a certificate where the retainer is not disputed, as in this case. The court further held that, pursuant to Paragraph 7 of the Advocates Remuneration Order, the applicant was entitled to interest at 14% per annum from 17/7/2021, being 30 days after service of the bill.
