The court found that the protestors, including Ciakuthii Njoroge, were neither wives nor children of the deceased and thus not beneficiaries under the Law of Succession Act. The evidence did not establish that the deceased had transferred or gifted Kyeni/Mufu/3060 to Ruanderi or his family, as any alleged sale or gift was incomplete and unperfected. The property remained registered in the deceased's name, and any claim based on sale or gift would require separate proceedings for specific performance.
