The court held that an appeal is a new and independent proceeding, and therefore a new advocate representing a party on appeal does not require leave under Order 9 Rule 9 to come on record. The application for stay of execution was filed without unreasonable delay, as it was made within two weeks of the judgment. The applicants, being in possession of the land, would suffer substantial loss if evicted before the appeal is determined. The court found it appropriate to grant a conditional stay of execution, requiring each applicant to deposit Kshs. 100,000 as security within 30 days, either in court or in a joint interest-earning account, and to deposit the taxed costs of the lower court....
