Since each appellant's claim was below the statutory limit, the Magistrates Court had pecuniary jurisdiction. However, the Nyeri Chief Magistrates Court lacked territorial jurisdiction because the cause of action arose in Gatanga, Murang’a County, and the respondent did not reside or carry on business in Nyeri. Therefore, the trial court erred in striking out the suit for lack of pecuniary jurisdiction but was correct regarding territorial jurisdiction. The appropriate remedy was to reinstate...
