The High Court retains jurisdiction to determine disputes over advocate-client accounts and funds, even where the Advocates Complaints Commission has statutory authority to investigate professional misconduct. The Applicant's grievances concern financial and contractual matters, not disciplinary offences, and thus fall squarely within the Court's powers under Order 52 of the Civil Procedure Rules. The Respondent, having failed to render an account or file a bill of costs despite holding substantial client funds, is under a legal duty to do so. The Court is empowered to compel the Respondent to file his Advocate/Client Bill of Costs for taxation, and to order that the funds held be applied...

Orders

  • The Respondent is ordered to file his Advocate/Client Bill of Costs for services rendered in CMCC No. 437 of 2018 in compliance with Schedule 7 of the Advocates Remuneration Order, 2014 before the Deputy Registrar for taxation.
  • The amount taxed by the Deputy Registrar shall be deducted from the amount held by the Respondent being KES 4,626,064.70 and the remainder (if any) released to the Applicant.
